Let me just explain this: I read the book "and then there were none." and this is my creative project, a mach trial for the killer *SPOILER* Justice wargrave. If you have read the book or are bored, then try reading this. reviews would be great. (note this is not finished yet)

Mach Trial

Cast:
Daniel Kantor: Prosecutor
Oliver Berger: Defense attorney
Judge: ????
Dock owner:
Wargrave:????

Judge: The trial for Mr. Justice Wargrave is now in session.

Oliver: The defense is ready.

Daniel: The prosecution is ready.

Judge: Mr. Kantor, your opening statement please.

Daniel: Very well your honor, the suspect was the only one on the island who could have done it. Every body else on that island was dead and the only person with any kind of motive left alive. His motive was simply his urge to murder as found in this letter he wrote. It was also the urge to serve justice. Every one of the victims has done some sort of crime involving one’s death but none have been put on trial due to lack of evidence. Wargrave took it into his own hands to serve Justice. That is all.

Judge: I see. Mr. Berger, your opening statement.

Oliver: Let me start off by saying that there are many flaws in your theory. First off, how do we know somebody did not come to the island or was already there?

Daniel: The police checked the whole island and…..

Oliver: He could have left in that long gap between the murders and the police arriving.

Daniel: So then answer this, why would he leave the judge alive?

Oliver: A person to take the blame of course.

Daniel: OBJECTION. That does not make any sense. Why would he leave a suspect and get him sent to jail when he could just kill him? These are all just theories. We need evidence, testimony, and overall proof of this statement. Although I have proof of my theory that Wargrave was the only possible killer. A witness.

Oliver: Who?

Daniel: The dock owner.
*Dock owner walks up to the witnesses seat. *

Daniel: State your name and occupation.

Dock owner: Austin Bruckner.

Daniel: Please testify if there were any boats leaving the dock from the weekend of the murder to the time the police came.

Austin: On Friday I was there all day. Nobody else left to that destination. There could have been somebody going on Saturday but I was not working then.

Oliver: Well, couldn’t somebody have left on Saturday and committed the crime?

Daniel: That is not possible because the first murder was committed Friday night.

Oliver: Didn’t Mr. Marston die of choking? Maybe that was just a coincidence.

Daniel: I am sorry but Doctor Armstrong checked and wrote down the autopsy report at the island.

Oliver: May I remind you that Armstrong is not the trustworthiest doctor. Hell I would guess that the good doctor was in a bottle half of the time.

Daniel: A man who drinks quite often is not an alcoholic.

Oliver: He was drunk while operating on a patient and killed her!

Daniel: That was never proven!

Oliver: Just because something is not proven doesn’t mean it is not true.

Judge: Enough! This is getting nowhere.

Oliver: Excuse me judge but I have a hard time believing that Wargrave is the only person who could have committed these heinous crimes.

Daniel: Very well. The witness will go back to his seat.

Judge: Let me start with you Mr. Kantor. You did not inform us on why you did not know who came Saturday.

Daniel: Your honor, it didn’t matter, one person was already dead at that time.

Judge: Nevertheless, it was a careless mistake. As for you Mr. Berger, you seem to think that Wargrave did not commit these crimes, however, you have not provided us with a suspect. This is your final chance, who do you think would have done these crimes other then Wargrave?

Oliver: There are two people who could have one it. Vera Claythorne and doctor Armstrong.

Daniel: That’s preposterous! Both were found dead… well uh except for…

Oliver: Doctor Armstrong. His body was found three days later after it washed up on the beach. As for Vera Claythorne, she was found hung. It seemed like a suicide though seeing as there was a chair kicked from under her. So can you explain this.

Daniel: Simple, Wargrave drowned Armstrong with his bare hands and forced Vera Claythorne to hang herself.

Oliver: Wrong, there was no sign of struggle.

Daniel: Did I say physical force? No. It was clearly psychological. Either she knew she was in danger or….

Oliver: Or guilt over killing so many other human beings or what she has committed in the past.

Daniel: You mean that case with the little boy drowning?

Oliver: Precisely.

Daniel: I see. Well I guess this answers my inquiry.

Oliver: I don’t fallow.

Daniel: I found a rather strange piece of evidence. It was a revolver with Vera Claythorne’s fingerprints.

Oliver: So this proves that Vera is the killer.

Daniel: OBJECTION! Vera may have killed Lombard, but that was out of self-defense.

Oliver: So is it possible that Lombard is the killer?





Daniel: It is possible but I believe that Vera killed Lombard because she THOUGHT he was the killer. Think about it, you are on an island and only you and another alive. There is a killer on the island and you know that it isn’t you so you must assume that the other is the killer. So Vera had no choice but to kill the other. Although Claythorne did not know that Wargrave was still alive and hiding.

Oliver: That means that Vera is still guilty of murder.

Daniel: Even though it was in self-defense, murder is murder so yes I agree. Although, it is too late seeing as she is passed on.

Oliver: This leaves Wargrave, Vera, and Lombard as suspects.

Daniel: Vera has killed Lombard as we have already proven and then hung herself. This leaves seven other victim’s death in question.

Daniel: This is how I see it so far: The suspect played the record stating everybody’s alleged crime and while every body was looking at the record, he quietly put poison into Marston’s glass. As for the death of Mrs. Rogers, he simply gave her something to help her relax.

Oliver: OBJECTION! Wargrave could not have given her the substance. The cup we found had two sets of fingerprints, Mrs. Rogers and Doctor Armstrong. So this would imply that doctor Armstrong was In fact the killer.

Daniel: I see… maybe he slipped into the glass?


Oliver: Not likely. Like I said, only the two touched the glass.

Daniel: What is your point? He did not have to touch it to drop medicine in a glass.

Oliver: Uh… well… I don’t think Wargrave would have time to put it in the glass himself.

Daniel: How can you tell? We have no testimony saying where she received the glass due to all other witnesses being dead.

Oliver: Well then I guess we have to bring out our last witness. Judge Wargrave.

Daniel: Agreed.

* Wargrave comes out *


Daniel: Please state your name and occupation.
Wargrave: My name is Justice Wargrave and I am a judge.

Daniel: Please testify on what happened when Marston died.

Wargrave: We were all relaxing and socializing but suddenly a record started playing. This record stated crimes each person has allegedly committed. After everybody settled down, Marston fell to the floor making sounds one would if one was being strangled. Then he stopped moving.

Daniel: Could you please tell us where you were when this was happening?

Wargrave: If I recall, I was on the sofa socializing with Armstrong.

Oliver: HOLD IT! Excuse me Wargrave but…

Wargrave: I would prefer you address me as “your honor” I am still a judge mind you.

Oliver: Ok…. Your honor, what were you talking about with Doctor Armstrong?

Wargrave: Our lives and our interests. Things you would talk about when first meeting somebody.

Oliver: OBJECTION! I am sorry but I have a hard time believing that you have never met him before.

Wargrave: Why is that.

Oliver: Because there was a time where you two have met before. In this very courtroom!!

Daniel: What? Explain your self!!

Oliver: Remember the accusation against Armstrong?

Daniel: Of course I do. He was accused of killing a woman on the operating table and the judge for that trial was………

Oliver: Judge Justice Wargrave.

Daniel: WHAT?

Oliver: So Wargrave, care to explain yourself?

Wargrave: A clever one you are. Since you figured it out I guess I have no choice but to tell you what we were talking about.

Daniel: That would be appreciated but please, only the truth this time.

Wargrave: Well, we were actually talking about the trial. The funny thing is that he admitted to being intoxicated while operating.

Oliver: Anything else you talked about?

Wargrave: No. That was it.

Daniel: If I may interject, there is another thing that seemed to bother me was that record. I happened to listen to it and you are not mentioned. Care to explain why?

Wargrave: Perhaps I have not done anything to cause the killer to want to mention.

Daniel: That is just plain illogical. Bring one person that is innocent to an island full of people who might have committed these crimes?

Oliver: So do you have an explanation of why he was called there?

Daniel: He was the murder of course.

Oliver: Bah! So far you have proven that Vera killed Lombard, Armstrong killed the patient, and Vera hung HERSELF. You have yet to prove that Wargrave is committed any crime. As far as we know, Vera killed every single one of them and left the Judge Wargrave as a suspect.

Daniel: I thought of that but it was impossible for Vera to have killed one person, doctor Armstrong. Armstrong was drowned correct? Armstrong was also somewhat of a well-built man. Do you really think that a woman would have the physical strength?

Oliver: Drugged perhaps?

Daniel: No. We tested him. Nothing in his blood stream other then alcohol.

Oliver: Lombard?

Daniel: Its possible.
