Capcom is looking to protect its right to kill hordes of zombies in a shopping center. In a legal complaint filed this week (PDF file via The Hollywood Reporter Esq.), the game publisher asserts that "humans battling zombies in a shopping mall" is a "wholly unprotectible idea" under today's copyright laws.

The reason for Capcom's fair use claim reportedly comes from a draft complaint sent to the company (as well as Microsoft and Best Buy) by The MKR Group, who claim intellectual ownership of both Dawn of the Dead films. Capcom's filing notes that the company unsuccessfully tried to discuss the matter and that the game features a disclaimer that reads, "This game was not developed, approved or licensed by the owners or creators of George A. Romero's Dawn of the Dead."

It's time to conduct a very (ahem) scientific poll.

Is Dead Rising too similar to Dawn of the Dead?
- Yes; in fact, all zombies that enter a shopping plaza immediately become property of The MKR Group

- Of course not, the disclaimer says it all. Why would a disclaimer lie to us?

- Did someone say Dead Rising 2?


Hahahahahahaha. Oh god, I'm so amused. Read the comments on that, seriously.

In my opinion, if this is true, MKR would have better luck suing Konami (who had ZOMBIES IN A MALL GASP! in one of the Silent Hill games) rather than suing Capcom.

Of course, on the other side of the coin, Capcom having a disclaimer on the box cover of Dead Rising saying it had nothing to do with DotD means they probably saw this coming.

Lame. Especially when it's 2 years after the game was released. I could see the similarities, but this is petty.


I guess Stallone, Arnie, & Ridley Scott should sue Konami because of the original Contra...the characters have likeness to both Stallone/Arnie, and the enemies are very "Alien" like.

John Carpenter/Kurt Russell should sue Hideo Kojima for the likeness of Snake to Snake Plissken.

I guess they failed to notice the sticker on the front of the game's cover that states: "This game was not developed, approved, or licensed by the owners or creators of George A. Romero's Dawn of the Dead."

OH. GOLLY. NOW I THINK ABOUT IT, THEY ARE SIMILAR.

THEY BOTH HAVE DOGS AND ARE IN A MALL.

Well put, I have seen Dawn of the Dead and the only actual resemblances are the fact the two involve zombies and a mall.

Damn. I love both Dawn of the Dead (The original, the remake sucked) and Dead Rising. Why must the Gods named Capcom and George Romero clash?

I don't think mr. Romero cares. He must be way too buisy with that Diary of the Dead thing he has cooking up. Stuff like this is handled by lawyers that has nothing better to do than google-searching the words "dead" and "zombie" in hopes of something sueable to pop up.

As a matter of fact, "Dead Rising" comes up on a google search on page 4 searching on 'zombie dead'.

I haven't seen Resident Evil been sued yet, so they must be blinded to it's presence.

Resident Evil doesn't include 'dead' or 'zombie' in their title. So they would be harder to find.

the world of the Coorporate Lawyer does not include such a thing as 'entertainment'. It's part of the education to have those unnececery thoughts (as well as 'humanity' and 'reason') removed through intense therapy. Else they wouldn't be able to do their job properly.

Anyway, for some reason, this reminds me of how Nintendo got sued because of Donkey Kong = King Kong. I suspect that the outcome will be identical: The fact that the lawyers won't be able to prove that they have a monopoly of the use of zombies in malls.

I always thought it was a bit odd they hadn't had any legal trouble.
