Micheal slammed his hands down on his desk, and glared at the defendant. "Testify as to what 'that' was. Now!". He didn't want the defence to construe what the defendant was saying in his favour.

Almost jumping from being startled by the Prosecution's exclamation, the Judge acted like he was sitting up more.
"Y-yes. Mr. Chartuex, please testify about, er, 'THAT'."

What "that" was...

:testimony:

"A while back me and Paul were investigating an empty warehouse."

"We recived a tip from somenone saying it was a supply cache that belonged to G.A.T.O. Crop."

"Me and Paul have been trying to stop G.A.T.O. Corp's illegal guns sale for years now."

"We found the place empty except for one crate, it contained a small robotic cat. The robotic cat being the 'that'."

"But honestly what does this have to do with the case?"

((It's okay to object without actually pointing to a statement, right? This particular objection is to the entire testimony, especially the final bit. If I need to change this post, please tell me.))

"G.A.T.O. Corp?" Xero crossed his arms and looked over at his client. "I'm afraid it seems to have more to do with the case than you think, Mr. Charteux. After all..." he procured the Receipt from the Court Record. "...Wasn't the name of that company on this receipt?"

((It's fine, Xero. Although, just for the sake of argument, there are other exclamations, like "Hold It!" that could have worked here. But like I said, I really don't mind either way.))

"Revise your previous testimony by adding anything you know about this G.A.T.O. Corp. into it. Hopefully Mr. Wright will find a way to lead this to our present situation, or we will have wasted our time. Do you understand, Mr. Wright? Don't dilly-dally."

"Is that all?" asked Xero, raising an eyebrow. "You're put on suspicion for murder, murder of your friend, who you had an argument with. It doesn't piece together. I wouldn't say it led to nothing... it led to a very firm belief that this is a weak motive, and I hold that, with the unidentified fingerprints on the scope, it is extremely likely that this murder was committed by someone else! Why? Because to use the scope on the gun, the defendant would have to put it on himself! Why, I ask, are his fingerprints not on the scope? That, coupled with this testimony, further lead to my point!"

((Bleh, I'm half-asleep, and I've re-written this post about 10 times now. Should I revise it?))

"Mr. Wright, removing fingerprints from a piece of evidence is certainly not an uncommon trick in a criminal's arsenal. To say the defendant is not guilty simply due some circumstantial evidence when everything else points to guilt is sheer idiocy!" Micheal stood tall and clicked and pointed at Xero, "I won't let idiocy let a murderer go free."

The Judge listened to both sides wage war across the courtroom, taking in both sides of the argument.

*Crack!* *Crack!* *Crack!*
The Judge banged his gavel, commanding complete silence.

"It would seem... we have reached an impasse. On the one side, like the defense said, it appears that Mr. Chartuex seems to have a poor motive for murder, and makes it hard to believe he really killed his friend..."
"But on the other side, like the prosecution pointed out, this is all conjecture, with no foundation. It may also be that the defendant is making this all up..."

The Judge paused again. He thought over the entire testimony for a second, and then realization came.
"The one thing I have yet to hear... is Mr. Chartuex's side of the story about what was occurring AT the time of the murder. Prosecution, Defense" he turned his attention towards Mr. Wright and Mr. Grey. "I want you two to pry everything you can from this last testimony. With this, I will decide if there have any need to continue with this trial. Keep in mind, even if I end this trial right now, I cannot call judgment until those prints have been analyzed. Still, with enough evidence to back up either of your arguments, I can easily decide whether or not there is any worth of prolonging the inevitable."

"Mr. Chartuex, for your final testimony, I want you to tell us everything about what occurred at the time of the murder-- that means right before, during and after."

Alex listened intently to the testimonies and cross-examinations that had occurred thus far. He closed his eyes, as he shouted

"Your Honor. Mr. Grey. Mr. Wright. While my place here may not be as an attorney, might I point out that while the scope was custom-made for Mr. Chartreux's gun... there is absolutely no evidence it was actually used in the crime!" the legal aide pointed out to the three of them.

"Honestly now, Your Honor? We have established that the scope was Mr. Chartreux's. It was found in Mr. Chartreux's apartment. It was specially made for the firearm that was used as the murder weapon...but there is absolutely no evidence to suggest the scope was affixed to the gun." Alex explained, gritting his teeth to keep from lashing out at the old man sitting above them.

"Before the murder had happened I was typing up a 'lost pet' flyer for my lost cat, Jinx."

"When Paul came in, we sat down and talked about small stuff. You know the weather, sports, ect..."

"Then when he brought up Jinx and how I should turn him in to the boss because he has some relation to G.A.T.O. Corp."

"Thats when I started to get angry."

"We started argueing and then when we finished he left."

"I got back to the computer and continued typing up the 'lost pet' flyers."

"I started to doze off but was awakened by a *BANG*"

"I looked out the window and saw Paul, laying in the street, blood pouring out from his head."

"I quickly ran down to check it out, but the police stopped be and arrested me on 'suspision of murder'."

Micheal pondered for a second, tapping his fingers on his desk as he thought. "Hmm, this scope seems so...irrelevant to the case." Micheal said quietly, he just couldn't connect it to anything, even the defendant claimed that the scope had nothing to do with him, despite the fact that he could have used it in his favor.

Micheal decided to speak up, "Your honor, I'd like to ask something unusual of the court, but I believe this scope has given us nothing of value so far, I'd like to request that this piece of evidence be removed from the court record."

shouted Alex. "Mr. Grey, regardless of its usefulness thus far, evidence is evidence. I presented a theory, which may be proven or disproven as this trial goes on. While I doubt its relevance as well...absolutely nothing can be ruled out in searching for the truth. I oppose Mr. Grey's motion, and request that it be kept in the court record until further notice."

Micheal glared at the assistant, wondering where he suddenly got his fire from. "While that may be all well and true, this piece of evidence is tying up court time through having the defence constantly ask questions about it, raise theories about it, and undoubtedly get more testimonies about it. This piece of evidence has become a pointless fixation in the courtroom, after the defendant himself's testimony says nothing about it, it's clear it's useless." Micheal clicked his fingers and pointed at the defence, "Unless you actually have something to say about it, then the previous testimonies show nothing about it and we can discard it!"

"Be that as it may, Mr. Grey, evidence cannot be simply 'discarded' from the Court Record... it was found at the crime scene, and thus, it must remain in the Record. I'd say the time's now being wasted by your arguing about the scope! As such, it may find its use later on... or it may not. But as long as it was at the crime scene, I'm afraid you cannot discard the Scope. I rule that we end this discussion and get back to the cross-examination!" He slammed his hands on the desk as he said this last sentence.

The Judge was a little surprised at the Defense's intensity.

"I'm afraid, Mr Grey, the defense is right. Whether it be a scope, gun, or scrap of paper, if it may have been involved with the murder of Mr. Slynx, it must remain," The judge said.

"At least until there is, without any reasonable doubt, no further use for it. There is nothing we can do on this matter right now. Unless the prosecution has any objections, we should continue to cross examine the witness..."

shouted the detective as he enthusiastically burst into the courtroom once again. His excitement was visibly bursting forth as he marched up to the stand.
"You'se guys will never guess what I got right here!" he declared. He held up a plastic-zipper bag revealing the scope, and then slapped a small file onto the stand. "It's that scope you'se wanted me to ID. And guess what? It's back from the lab! But if you wanna know whose prints are mucking it all up? Fuhgeddaboudit!"

Murmers arose from the crowd as they heard Mr. Ercatore say he wouldn't tell the ID of the prints.
What's wrong with this detective?
Why won't he tell whose fingerprints they are?
That judge should hold him in contepmt or something!


As Rick heard all this he started to defend himself. "'Ey, 'ey! Calm down, calm down! 'Tsa matta f'you? I ain't holdin' away no information from the court. It's just I can't tell you'se who belongs to dem's fingerprints, because they were untraceable!"

Scope Updated in Court Record.
Scope Fingerprint Analysis Results: After sending a copy of the prints to be cross-referenced by the crime-lab's computer, the tests show that the prints do not match up to anybody on record. RESULTS: INCONCLUSIVE.


"We ain't got no records that ever says who belongs to these here prints," finished Rick. "It's all a big blank!"

The Judge stood up in his stand.

"Untraceable!? But that's impossible!!" The Judge was beginning to sweat.
"The modern legal system requires that every citizen have their fingerprints I.D.ed ! There is no conceivable way that somebody could not be in the system!"

The Judge turned his full attention toward the Detective.

"Are you sure this is correct!! Could this be a mistake!?"

"Tch...The one useful thing that could've come out of that scope, the only possible reason we're holding unto it just disappeared." Micheal glared at Xero, he was going to have this piece of evidence removed no matter what it took.

Micheal was holding unto the edge of his table, leaning over with a look of stress and determination on his face, his hands gripped tightly on the table. "The scope itself only magnifies the shot, It does nothing to the bullet, the shot could have still been made if the shooter was an able shot. It has no fingerprints on it, the shot could have happened without it, it has no bearing on this case, damn you!"

"Unless my client here was an expert marksman, there was no way he could have shot someone from his room, especially from behind a closed window! There's also the fact that Mr. Slynx was killed in ONE SHOT!" Xero pointed outward. "My point still stands! Unless YOU, Mr. Gray, can prove that my client could make the shot without the scope, or that he somehow has enough marksman skill to make an expert shot like that, I hold that this argument is simply wasting the court's time!"

Micheal stood up, and tried to collect his composure. "Hah, anything is possible, Mr. Wright. It's entirely possible it was a lucky shot and he intended to fire multiple times originally. How about you point out how this item connects to the case instead, although it was found at the crime scene, it was unconnected from the gun and has no fingerprints on it, making it irrelevant. I distinctly remember several pillows being found at the apartment, yet none of these are in the court record, so why should this scope be here?"

"The scope could have been detached, of course!" Xero argued back. "And, nobody only fires once if they intend to kill someone! They don't just wait for someone to fall on the street before deciding 'Hey, should I fire again or not? Is he dead?'! Doing that would obviously, in the shooter's mind, make it a hell of a lot easier to figure out where the shots came from, than if the shots were fired in rapid succession!"

"Actually, if they defendant could clearly see the victim was dead from the first shot, firing multiple times would simply leave more shells and and draw more of a scene, so yes, any killer with half a brain will avoid shooting more than necessary. The scope could have been detached, but the killer would likely have had no time to wipe the prints! Your honor, I call for a ruling on the matter of this scope, now!"

Current Items in the Court Records:
-Attorney's Badge: 'Nobody would believe I was an Attorney without this,' is inscribed in the back of it. Must be the motto.

-Ricky's "M1911A1 Colt" pistol (Murder Weapon): Fired Once. Registered to the defendant, and has the defendant's finger prints on it. Was found on the floor near the window.

-Special Scope: Was customized to attach to the murder weapon. Prints are located on it, but none can be matched. Apparently special-ordered. Found at the scene on the floor near the window.

-Receipt: Receipt for custom scope from an unknown company, "G.A.T.O. Corp.". Found along with the gun and scope.

-Crime-scene Diagram: A diagram of the crime scene, seen from above. Depicts the location of the weapon, evidence, and the state of the room. ((Click this LINK to view.))

-Scope Fingerprint Analysis Results:
The scope was sent to the crime lab to have the fingerprints cross-referenced by the crime-lab's computer. The tests show that the prints that were present do not match up to anyone on record. RESULTS: INCONCLUSIVE.


The Judge looked like he was thinking deep.
"...this scope... is very befuddling."

"It was found at the scene, yet the defendant claims to know nothing about it.
"It has prints from another source, yet these very prints cannot be ID'd.
"It would appear, at this point, as if this scope is false evidence. But that leaves two questions...
"Why would the defendant own a scope he never seemed to have touched, and WHO, if not the defendant, would have left it at the scene?"

He looked out over the court.
"It seems completely impossible that a man could shoot a pistol through a glass window and accurately hit a moving target from 30 feet away from him... but this is appears to have happened."

The Judge sat up and held his gavel.

Xero stood there, thinking over everything he had learned over the course of the trial. Try as he might, he couldn't figure out what to say that hasn't already been said. He knew that a bluff wouldn't work here, that it had to have been something that has been told to him.

He turned to his assistant. "Alex, I have no idea what to say."

"Hah!" Shouted Micheal, smirking while looking over at the defence. He crossed his arms, "Your honor, the defence has nothing, the evidence has no use!". Micheal had got exactly what he wanted, he just needed more things like that and the trial would be his.
