It made me sad because the fact that the person was flying made it seem like there was no real threat, since they were no explanation for how Max did it....

Maybe. But then there would probably be some evidence of the strings, or maybe even setting it up, and the murder weapon would be missing.
And there's still the hat contradiction.

EDIT: I was thinking about in this case if you just started off with Acro in day 2. I thought you didn't, b/c I felt that was too short, so I checked a strategy guide (on gamefaqs) just to check, and came across this line in the summary of Franziska's opening statement:
GRARG. Now I'm really mad. They tell us Franzy has an explanation, force Gumshoe to do a mock-up, and don't even tell us!!
(Although I don't remember this line, so the author may be wrong, but I doubt it.)

After all, they did say one of their main reasons for choosing him was because he was the only one who could "fly." That's what I thought, at least.

She obviously noticed it. But instead of trying to work an explanation for it into her case, she just came up with an excuse and hoped that no one would ask her about it in court. Not exactly perfect, Franny. :\
I think this falls into the same category. She had no idea how Max flew (or even if she did know that he used wires and pullys, obviously those things weren't discovered at the crime scene) so she tried to just BS the court into believing it was real magic.

I agree. If she admitted the most obvious conclusion; ropes and pulling Max up, then suspicion would fall on Acro. Franziska couldn't come with a better excuse, so she just hid that fact. Also, I think she was following in her father's footsteps a little. Yesterday I was replaying 1-4 and I came to the part at the end of the case where...
...Not exactly the same, but similar sorta thing. Franny is far from perfect, but she's hiding the evidence to make it look like she is.
