From what I've read around the forums, it's pretty heavily implied, but never actually stated.

I highly doubt it. He most likely wouldn't have been sentenced to death, since he did kill in defense of Maya. I view his presence along with Mia and Misty as a sort-of tribute to the past and to the "teachers", as opposed to the dead.

You're wrong, It's heavily implied he's dead. :3
