But in the first two games (at least) whenever he presents evidence that he finds himself (for example the wiretap in 1-2), neither the judge or the prosecution raise the possibility that Phoenix has made it up.
Can someone please explain to me, what is different about the case Phoenix takes after 3-5 is concluded (the one that get him disquailified from being a lawyer)?

But in this case, he used it as real evidence; and got caught out when he finds out it was faked. Also:
