Well, near the end Kyouya did accuse him of "being scared all these years." Maybe he was just too scared to try and kill Phoenix, Hamigaki, the Eses, because he was so bad at murder in the first place XD;;.

The stamp was actually a good idea, considering it required Makoto sending the only evidence of the crime back to him. And he thought he was so smart, using the Arumajiki she liked. BACKFIRED~

If this were D&D, Kirihito would have a nasty tendency to roll Critical Fumbles on all of his murder attempts.

Like, if he tried to just shoot Makoto, he'd end up ricocheting the bullet off something and shooting himself in the nuts.

I think they went over all that to get Kirihito to prevent a Darke Killings case all over again. Kirihito was slowly becoming the kind of guy to kill someone because he was, I don't know, buying a hotdog right at the scene where he killed another someone for being a possible witness to the murder of- you get what I mean.

They're still traumatized about what had happened years ago with the Skyes, Marshall, Starr and Gant to consider Kirihito "not as dangerous".

And even if he was still in jail, he had to be declared guilty of ALL the crimes he committed.

However, we'll have to see what happens to Kyouya for this one. If we know our franchise, another prosecutor will take the stand for GS5. (And it better be a sexy one.)

Actually thinking about it, I think having the nuu prosecutor might bring out a darker side in Kyouya :F (Darnit, Despite me knowing a lot about this Game without buying it, I WANT IT SOO MUCH! I gotta step up with my japanese learning.)

Hm, I don't quite agree with that. Kirihito didn't commit murder haphazardly - in fact, he held back in places he probably shouldn't have. Originally he only intended to kill Makoto because she was the only one that knew he ordered the forgery. If he really meant to cover up his crime as desperately as Darke did, he would have killed Phoenix, Doburoku, Hamigaki - Maybe even his own brother, since Kyouya knew that Kirihito had information about the forgery before anyone else should have.

Despite being the villain, Kirihito didn't really seem like the kind to kill needlessly. Though if they really wanted you to be intimidated by him, maybe he should have...?

...And Croik, I think you have a point there, indeed. Kirihito did not kill enough to be called another Darke, but if Phoenix (and Odoroki, of course) hadn't gotten him in jail, he would have slowly evolved to that state. Or at least that's what I think.
