Trial DB-22: Turnabout Forgery, Day 1

This first day of trial has brought forth one of two witnesses to the crime: eccentric freelance film director Noah Remington. He was looking for a setting for his new movie idea when he overheard the argument and the gunshot, both of which were captured on his portable camera. An inexplicable hole has thrown suspicion on Mr. Remington's testimony, however: evidence shows that the witness entered the living room of the house from the open back door, and in doing so somehow tracked in maple leaves which were covered with dried blood--the blood of the victim. Remington says doesn't know how these bloody leaves found their way onto his shoes, which has left the court unable to do anything but ask him to recall the incident from the beginning in light of this new information.
We pick back up on the trial with Remington's most recent testimony (I'm not including the questions following this testimony because, frankly, they weren't leading anywhere)

"Ah, yes! 'From the beginning,' you said? Of course. I apologize for my...avoidant behavior on the topic. Let's see..."
-- Compromising the scene --
- The murder occurred two days ago,
- That night, I had been walking down the street with my camera, looking for a house to use as the setting for my latest film
- I heard two men arguing in the victim's house.
- At the end of the argument there was a gunshot, and I ran towards the house.
- I considered going through the front door, but decided to check the backyard instead.
- The back door was open when I arrived.
- I stepped inside to get a better look at the scene, I'm sorry, I wasn't thinking properly!
- I didn't notice until I'd gone inside that I'd somehow tracked bloody leaves into the room
- I knew before I went to the crime scene that I had blood on my shoes, but now I can't remember where it came from...
- The leaves on the body did not come from my shoes, though. I never touched the body.
- I didn't mention it in my testimony because everyone would be suspicious of me!
"...that's all that I know about the case. I understand that those bloody leaves have caused everyone a lot of trouble, and I'm sorry that I don't remember how they got there, but I really had nothing to do with this murder!"
Wyvern held up his hand to let Noah know that it was okay to stop. It was the first testimony that he'd paid full attention to all day.
"Thank you for your honesty Mr. Remington."

"It's a sensible explanation," Prosecutor Wyvern replied while idly flipping through the court record, "I don't think most people typically stalk around others' backyards. Then again...I've heard stories of some particularly atypical defense attorneys in my time..."

"The witness has already admitted that the leaves came from his shoes. Just to clarify, the bloody leaves follow a different path into the living room than the bloody footprints that were traced to the defendant's shoes. Regardless of why those leaves were there, the rest of this witness' testimony can't be faulted. Mr. Remington heard and recorded the voice of Ross Heckler two nights ago, when the victim was murdered! There's nothing about this that can be doubted."

A moment of silence passed before Remington looked at Prosecutor Wyvern, surprised that he didn't jump in with his usual comments. He seemed to be looking over something in the court record with an unusual amount of intensity.
(wait a second...I think this might finally be why I was feeling so uneasy. This note here...it doesn't match up with what we've been saying. But I've heard the testimony of two witnesses who seem so sure that... "...er, oh? Oh! Right, I think that the witness has sufficiently answered the defense's question. Please continue with the cross-examination."
(This oversight could have disastrous consequences for the progression of this case...what should I do...?)

Wyvern nodded at the comments, finally seeming to calm down after his bout with the court record from earlier. He still didn't feel confident enough to resume his usual lean against the gallery or pulling out his book, instead keeping his hands planted firmly at his desk. As long as the defense couldn't present any contradictions to break this testimony, he'd get his guilty verdict for Heckler. He was close, he could feel it...

But he said during that first testimony that he wasn't there at the shooting and that it couldn't have been you because you had the video.
Why would he need to be afraid if he had the video?

As Wyvern runs out of words, Remington blinks in surprise. He nervously readjusts his hat.
"You know...that's a good point. The video does clear me of suspicion, and in the end I'm standing here telling you all about the leaves anyway, so I suppose there's no harm done. I guess I was simply trying to keep myself as distant from the crime itself as possible? I've never been a murder witness before, so I suppose I wasn't thinking about it the right way."
(...he says that as though being a murder witness is something you're expected to do. What a peculiar man.)
"Erm...at any rate, I don't see what difference it makes regarding why he hid this fact from the court. Please stop grasping at the end of the rope, Mr. Wilder, unless you truly feel that the witness' testimony contradicts the facts of the case...?"
(It's certainly taking longer than I anticipated to crack this testimony...here's a hint: though it was the most recent revelation, I'd say that you're focusing on the leaves too much. Try looking elsewhere in the testimony for your much-needed contradiction.))

"'Left the scene?' If by that you mean why I went outside, then no, I didn't even notice that I'd tracked the leaves inside until after I'd already walked back onto the back porch. I left the room because I'd heard one of the neighbors yell something from his own backyard, so I returned outside to inform him of the crime. We both waited on the patio until the authorities arrived."

(He's grasping at anything he can find...I can tell that much at least. Time seems to be an enemy of his...in more ways than one.)

Wyvern nods slowly, though he seems noticeably shaken for the first time today. He keeps flipping between two pages of the court record, seemingly trying to come up with something, but inspiration eludes him.

(What the heck am I supposed to do here? I don't think that the autopsy is incorrect, but if so...I have no way to explain this! How did I miss this before?! If the victim was already dead when Remington came by, then my whole case is useless! But wait...)
"This is quite a predicament, it seems. Defense, the evidence you're presenting suggests that the victim was dead before Mr. Remington arrived at the scene. However, both Remington and an additional witness have recalled hearing an argument between the victim and the defendant on the night of the 16th, and the police were not notified of any crime until the night of the 16th. Uhh... Well... It can mean... a number of things...
*Thinks a bit, Eyes widen, Wilder begins to grin broadly*
It could mean that the crime scene was a fake... The leaves on the body... The body could have been moved! ...
But more importantly... I feel it takes Remington's alibi away! If it was all staged then that tape means nothing! It could also explain that curious little victim's blood on his shoes!

Jeff thought for a bit, then suddenly reeled back. "Of course! It makes perfect sense! Doc, think about a piece of evidence that didn't seem to have anything to do with the crime! It might have EVERYTHING to do with it!"

Wyvern looks over his notes a few more times, searching for...something. Anything.
"But...but I...I heard the argument...heard the gunshot...I swear someone ran away from the scene...how could all of that have been...fake?"
"Hmmm........the witness has a point. Why go through all of this trouble to set up a crime scene? Especially if the victim really was killed in another location?"
(Unfortunately...I don't have answers to any of these questions. Both of the witnesses I spoke to were convinced that the murder occurred two nights ago, not three. I don't even know if I have enough evidence to continue the case here...!)

You see, something's been bothering me. Something's been bothering me for a very long time, and it's been drilling into my insides for this entire trial. You heard them arguing LOUDLY! But... you were a good distance away from the "scene of the crime", so how loud did they have to shout? Would the defendant even be able to talk if they were yelling that loud? *Holds out one hand* That's part one.
Then comes the stereo! It was on, but nothing was playing. How high was the volume turned up on that stereo? *Holds up other hand* That's part two.
Now what if... The argument between the two was somehow recorded? If the recorded argument was played on the stereo at a loud enough volume, it would explain how Remington was able to hear the argument! This theory further adds to the notion that this crime scene was a fake! *Locks fingers together* And look at how it all connects.
But... Why go to all this trouble? To create a witness. And it succeeded beautifully! This man stands before the court convinced that what he witnessed was the true murder, but he, like us, was fooled.
It all sounds crazy... Hell, if it wasn't I wouldn't be suggesting it! But a verdict cannot be reached until we investigate this matter further!

"However...due to the nature of this oversight, I must admit we are not prepared to challenge the defense's theory." (And since Remington's testimony in conjunction with the evidence collected pointed solidly at Heckler, I didn't think I needed to have the other witness prepared for today...) "So...it seems we've hit a roadblock."
(There's nothing more I can do today...not until I take a closer look at that crime scene, anyway. That oversight of the investigators is going to cost me a one-day victory. Blast.)
