"Tsk," Martha said. "If you are saying that how they were positioned exactly how the prosecution described, then there should be no problem labeling where they are. Unless you're scared of messing up..."

Lucias coughed slightly.

He didn't like having the credit so simply stolen from him like that... and the fact that Fernando kept looking at somebody in the audience was making Lucias slightly put-off. However, biases had to be put away. He was a prosecutor, that's all there was for now, nothing else.

:objection:
"You know I already described how they were positioned word-for-word... Miss Attorney, unless you honestly think that scaring the witness into slipping up in some sort of twisted game of 'Simon Says' is really worthwhile in a courtroom, this has gotta be a waste of time."

"Besides, you already got a strike trying to clear that out." Fernando said, looking at Martha with a gaze that is calling her an idiot. The audience laughed. The Judge silenced them.

"But seriously, I'm the detective, not the witness, so save such tactics for the suspicious witnesses (if any)."

"Fine," Martha said. I have to think of a new tactic. "So you say my client was on one side, the wife was on the opposite side, and the kids were in the corner, correct?" she asked. Martha was just making sure so as not to jump head-first into a trap.

Lucias had been editing the copy of his Floor layout with a pencil. He was setting up for his next attempt, but at the moment, he just wanted to get a good reminder of the locations that fit what Fernando had said.

Thib was being awfully quiet.
He began to chew the end of his pen.
"Grr... I know there's something wrong, but I can't place it...
Where were the children when they were shot, anyway? One was shot in the chest...
If that child was shot while running away, it could be fatal for the prosecution...
As the defendant would be the only one who couldn't shoot him. Why hasn't anyone asked?"

Martha realized that there was something wrong with the locations. A contradiction, actually. She smiled to herself, but decided she'd better not question it until she was sure the prosecution wouldn't be able to worm their way out of it.
"So, the child that was shot on the chest...Which one was he? The one that was closer or the one that was farther away from Mr. Machino?" Martha asked.

Lucias stepped in again.

"Miss Attorney, is that really vital? I can see where you are going with this-- in fact, I would've been disappointed if you didn't --but I can assure you that you are going to waste our time." Gesturing to Fernando, he said. "By all means, please explain which child was which?"

Fernando noticed Lucias editing the map before he asked him about where the kids sat at. He walked over and looked at the map. He nodded at what he saw. "He shot his son first, in the chest, like the autopsy report said. It was an easy shot. The daughter, despite being cornered, crawled over his head brother, so she could try to escape, but the defendant shot her while she was trying to climb over her brother." Fernando explained, returning to the witness stand.

Fernando smacked his hand onto his face, then sighed. "Yes, Ms. Fey, he is." He said, keeping his hand on his face. "Is there anything else you want to know that isn't something I already said?" Fernando asked, clearly annoyed.

"Just making sure," Martha said innocently. "Because it's strange."
She updated her floor plans.
"And so...About the son...You testified that the kids ran to get help, right? How far did the son get?" she asked patiently, smiling at her trump.

Fernando gave Martha the idiot's stare, keeping his hand on his face. "The son, sitting across from the defendant, suffered from the shots to the chest. The daughter, however, was the one who ran for help, got shot, suffered spinal cord damage, then died. Any more questions? In before criticism regarding the fact that I did not answer your question because it is now invalid. It have been invalid ever since the prosecutor submitted the autopsy report to the court record."

WHAT THE HELL IS WRONG WITH YOU?!" Fernando asked in annoyed fury, banging the desk in front of him, causing a small reaction from the audience. "If you would just look at the freaking map, you'd see that the defendant is sitting next to his wife, who, in case you didn't know, was the first one who got killed. The kids were on the opposite side of the table from the defendant! You don't have to be in point-blank to sustain the damages I described. Your honor?"

The Judge nodded. "Overruled. Ms. Fey, this is your second strike. If you are having problems with the witness' testimony, then I'll have this case adjourned for a 15 minute break." The Judge told Martha.

This was a slaughter. Lucias almost couldn't take seeing this woman get thrashed so badly.

"Now, now, don't forget that she didn't get a chance to look at my little doodle here," Lucias said, holding up his drawing on the scene:

"Oh..." Martha said. She mentally slapped herself for slipping like that. Pull it together, Martha. Al Machino's life depends on you not screwing this up. "But they are still right across the table from him, according to the picture. How big is the table?" she asked.

((Insert character))

A woman in a stylish red jacket and black slacks stirs a bit in the audience as she nibbles on her pencil, raising her eyebrow as she observes the prosecutor and the defense attorney. She shakes her head, feeling a bit sorry for the defense attorney who is messing up so badly. She glances back at the prosecutor and raises her eyebrow again at his messy hair. She shakes her head and pushes a bit of her auburn hair away from her face before returning to writing in the notepad that has been sitting in a lonely manner on her lap during her period of observing.

Fernando closed one eye, then extended his left arm forward. His other, opened eye indicated he was trying to remember something. He bent his back a bit, as to give him further distance forward. He continued to think, then nodded his head. "From my lower back to my tips of the fingers on my right hand (in my current position)." He told Martha, returning to his normal position when he deemed that Martha understood.

Martha rummaged through her purse for a minute, glad she always brought measuring devices with her so she could investigate crime scenes. Finally, she pulled out a meter stick. She waited for the bailiff to bring the meter stick over to the detective.

The bailiff did just that. Except, he measured the detective's indicated length. "1.50 meters." The bailiff announced, then returning the meter stick to Martha.

Thib noticed a woman with red hair sitting near him with a pad of paper.
Not really caring that she seemed to be concentrating on something else, he tried to get her attention.
"Hey. Hey. Hey. HELLO. OVER HERE." He snapped his fingers.
Thib was being persistent because he was anxious. He knew there was a vital detail that hadn't yet been mentioned, but had no clue what this vital detail might be.
If Asuka, this lady (whoever she was), and him put their heads together, maybe they could figure something out.

"One point five meters? What is the farthest possible distance for there to be a ring around the gunshot wound?" she asked since she had already forgotten that. Something that was very unlike her, as she could usually recall details easily. Martha decided it must be her nerves that were causing her to forget.

"They came in before me, to clear things out, obviously. You can't have an investigation with everyone bouncing off the walls, can you?" Fernando asked. "After things settled down, I came in to investigate what happened."

"Let me see..." Fernando took a thinking pose. "I estimated that the time of death was around 8:10 PM... Police got the call within the minute of his death.. It took me 15 minutes to get there..... No wait, police called me after they calmed everyone down at 8:25, when they arrived.... It took me 15 minutes to arrive as well, so that would mean that I arrived at 8:40 PM." Fernando explained.

"Ol' Donny himself." Fernando said calmly, but it was clear that he couldn't stand any more questions from Martha.

In the audience, Don expressed rage on his face. It was clear that he wanted to beat up Fernando.

Martha then remembered how she asked him to talk with Don earlier. If she knew Fernando like she thought he did, she predicted he'd probably get really angry at the prosecutor for asking that.

Lucias stifled a laugh. It was the kind of laugh you make at a comedy performance in some jazz club downtown, where the jokes were always funny, if not a little silly.

"I was just curious" Lucias said, in between light chuckles. "After all, Palochini isn't the most common name. Neither is mine, so I'd assume somebody who walked up as another Mr. Meracad was my long lost bro or something. I was only following those lines of deduction that you and Don could be related."
