up b = psych lock (uses chains as a recovery. covers the opponent in a lock sort of like yoshi's eggs)
side b = take that (throws attorney's badge)
b = objection ( points finger. hitting people causes damage)
final smash = super objection (pheonix grows huge and uses his objection move.)

See, I can imagine some cool original sprites, but the whole thing would be better in a more traditional fighting game, because...erm...it would look....cooler...or something. Y'know, with closeups and background changes. His special moves could be the Judge's Hammer (Like Sonson's pole smash thingie in MvC2), Super Take That (Chuck a load of random stuff at the enemy), and a few others (Summons? I don't know.)

It's very difficult to make him into a playable character, but what about a powerup?
Now I've never played any of the Super Smash Bros games, and I've only seen the two trailers of SSBB, but perhaps Phoenix could be a collectible item on the battlefield, a coin with his face on or something. When the coin is taken, then whenever someone uses one of those really powerful attacks (like Mario had his fireball wall, Zelda had the Triforce slash and Kirby cooked the opponents), the player could then use the coin to shout out "Objection!" and stop the really powerful move.
That probably made no sense, so I'll try and make some pictures to explain what I'm talking about.
This would be the item. The item randomly appears somewhere in the arena.

And in this picture, Link has used that Triforce move that traps Mario. Lets say Mario previously collected an Attorney's Badge. Mario would use that item during the special move, and this would happen.

The special attack immediately ends, and any damage made during the special attack is ignored, and the game continues as normal.

Too bad there's no chance of it happening, EA now owns the rights to Marvel. ;_;
But yeah, I agree. Phoenix isn't really suited for Brawl, although I wouldn't object to having him in. It'd introduce more people to the series.

-Objection (B): Phoenix points with his finger and shouts. The Objection! Logo appears and acts like a beam/shot, then dissapears. The people hit by the finger or the Objetion! logo is damaged.
-Hold It! (Up B): Phoenix shouts and make a high jump to reach cliffs and go back to the battlefield (Inspirated by his comebacks). The Hold It! Logo appears near Phoenix. The people hit by the Hold It! is damaged.
-Take That (Side B): Pheonix shouts and throws decisive evidence (Like The Thinker and a certain case file) and maybe his cellphone (Like when he throws his cellphone to Edgeworth).
-Examination (Down B): Grab from his pocket (A desk XD) a paper and looks at it carefully. Then the next time you use Down B, you will use randomly the Down B attack from another opponent in the field (Just as he uses the evidence presented by the prossecutors to "attack")
