Ivan was in the lobby with Mr. Roxburghe and and his client, Mr. Smith. He didn't think it was going to be that hard, but the rumors said the prosecutor would be Michael Gray. That made it hard. "Yes, Mr. Smith. Don't worry, we'll make our best to get you a 'Not Guilty' veredict. But, before entering the courtroom, I have one last question to you:", Ivan had forgotten to ask this to his client when at the Detention Center, but he was focused in the whole Phsyce-Lock thing. Now that he thought about it, he couldn't break all his Phsyce-Locks, but the info they had gathered was surely enough. "Did you shoot Mr. Doe?"

Jonothan looked at his attorney with his usually serious look, "No, I didn't." With this statement, there were no psyche-locks. Apparently, he was telling the truth, but despite that, there is always a chance of an incorrect verdict.

"Okay, it seems it is time to go inside..."

February 2nd 10:00 AM
District Courtroom
Courtroom No. 7

The onlookers begin mumbling to themselves, none of it really legible. The Defense and his assistant sit next to their client, Jonothan Smith while the Prosecution, his assistant, and their first witness, Ms. Ema Skye were siting on the opposite side of the room. The judge sits atop his balcony, overlooking the rest of the courtroom as he reaches for, and bangs his gavel.

The judge clears his throat and begins, "Court is now in session for the trial of a Mr. Jonothan Smith one the count of Murder in the first degree. How does the defendant plea?"

Jonothan stands up, "Not Guilty, your honor."

The judge nods, "So be it. Is the Defense and Prosecution ready?"

--------------------------------

TRIAL NO. 1

Welcome to the start of the first trial!

At this time, the prosecution must call the acting detective, Ms. Ema Skye, as their first witness.

You may also call both or either the Bellboy and the defendant, but it is impossible to call any other witnesses in this first day.

Dominic fidgeted under the defence desk. He stood out in a formal setting, and he knew it. He'd had a shave this morning, but already the stubble seemed to be growing back. "Well," he whispered to Mr Ramos, "it looks like it's time to get things going, sir. Just remember: Mr Smith is innocent, so you just need to work at picking apart testimonies, and the truth will come out."

Micheal was glaring angrily at the defence, he was in a particularly bad mood and had a bad feeling about the case. Having his arms crossed, he'd only make the occasional movement to glance at the court papers in front of him, to make sure everything was in order. Without moving his eyes, Micheal spoke up, "The prosecution is ready, your honor."

Ivan was next to Mr. Roxburghe and Mr. Smith. "The defense is ready, Your Honor.", he said after the Prosecutor's words. "Yeah, Dominic, we know he is inoccent, and we just need to prove it.", he whispered at his assistant. "We cleared a lot of things yesterday, with the whole Hakuro de Killer thing, so I think we've got some trails to follow."

Detective Skye was waiting in the prosecutor's lobby to be called to testify. "Hmmm, let's see, I should mention that, and I think Mr. Gray said I shouldn't even bring that up..." she was holding up the entire case file in her hand reviewing it.

Micheal cleared his throat, "Your honor, the prosecution feels that there are too many unanswered questions to have a verdict declared immediately on this case, and that there's much questioning needed to be done to all parties involved before we can call the verdict."

Ivan was next to Mr. Roxburghe, listening to Prosecutor Gray. He thought the first witness would be Detective Skye, since the Detective in charge of the case is usually the first to testify. "Are you ready, Mr. Roxburghe? This will be hard, but we know he didn't do it, so we have to prove it.", he said to the Defense Aide, waiting for the Prosecution to call a witness, or the witness.

"Your honor, if it pleases the court, The prosecution will now call a one Ms. Skye to the stand to testify as to the police findings on the case." Micheal glanced towards the door, expecting her to walk in right on her que.

Dominic failed to suppress his brief smirk. "Ah good," he whispered to Mr Ramos, "it's so much better to start off with a looker, and someone I think we can trust to be honest." Dominic stroked his chin and stared off into space. "You know, there was something I meant to ask her yesterday, but I've completely forgotten it. I hope something jogs my memory on that."

Ema was summoned to the stand and she briefly noted the prosecution and defense. "I believe the bare facts are the first order of business correct?"

:testimony:

--The Bare Facts--

"The victim was Mr. John Doe, who suffered a single gunshot wound to the heart."

"After analysis, it was revealed that the gun belonged to Mr. Jonathan Smith, the Defendant.

"The place, or crimescene in question is the Gatewater hotel, of which the victim and defendant were regulars."

"Furthermore, there were several witnesses who saw the defendant."

"That is all your honor." Ema paused and waited for the cross-examination to begin. She wondered if she should mention the victim's secret or not.

"Very well. I will start the Cross-Examination when you say, Your Honor.", Ivan said to the Judge. He couldn't find anything weird or strange in the Testimony, so he would have to press on some things. "So, Mr. Roxburghe, did you find anything? I can't see nothing fishy, but a cross-examination will reveal some things." He looked throught the Court Record once more, but didn't find any contradiction. He better pressed in there or he was just dead.

((So, Hakuro, does she have to post statement by statement or she posts the whole testimony and I press and present, like, 'Objection! (at statement 1)' or 'Hold It! (at statement 4)'?))

((Basically, this is supposed to be as true to the games as possible while adding some open-endedness. Therefore, Syke did this correctly. Now you press and present as you see fit. You will be penalized if there is no relevance to the portion of testimony.))

The Judge nods again, "Well, this seems like an open and shut case. You may conduct your cross examination, Mr. Ramos."

:examination:

---------------------------
Your First Cross Examination

How this will work is you have two choices for each statement made: Press or Present.

When you press a statement, the witness is obliged to elaborate. At the end, you may choose to press farther or add to the testimony. However, if there is no need to press farther either because there is nothing more to add or pressing farther isn't relevant according to the judge, you will be penalized. You may choose to add any elaboration to the current testimony. If you do so, you must use the addition to testimony somehow or you will be penalized for stalling.

You may choose to present evidence or even profiles of those involved in the case to any statement. If the evidence is relevant, the witness is obliged to elaborate. if it isn't relevant according to the judge, you will be penalized.

NOTE: The judge, as everyone knows, is a simpleton. Therefore, as I am playing the judge, I will go reasonably easy. However, the prosecution has the ability to chime in any time with an objection of his own.

Dominic frowned. He'd seen so many cases where the detective had left a gaping hole in their opening testimony that he'd come to expect it. "Well, sir, I can't see any contradictions there, but I guess that's to be expected. What we need is more information. I'm curious as to who all the witnesses were. Ms Oldbag was one, but she was alone at the time. It wouldn't hurt to find out the other names, though I'm not sure if Mr Grey would allow such a hold-up."

Dominic turned his eyes to the court record. His gaze fell upon the crime photo. "Wait a minute..." he whispered. He showed the photo to Mr Ramos. "Look very closely at this photo, and think back to human biology." He was sure the prosecution would be listening, so he would have to be as cryptic as possible, to prevent their only lead from being lost. "If all else fails..." Dominic placed his hand over the left side of his chest. "...listen to your heart."

((I'm aware that the this has been indirectly explained in the sign-up topic, but I'm pretty sure the defence wouldn't know the explanation.))

((You would be correct on whatever I think you mean. If you meant about Mr. Doe being Shelly de Killer, then the defense doesn't know. However, Detective Skye and the Prosecution already know this and to my knowledge, the defense hasn't been informed. If you meant the blood relation between Mr. Doe and Mr. Smith, than not only does the defense not know, but nobody except Mr. Smith knows this.))

((Sorry for LONG delay, reason: school and homework... and Brawl.))

Ivan listened to Mr. Roxburghe and saw the photograph. The bullet wound... the position of the bullet wound. He understood some things and said: "Mr. Roxburghe, I got you. If I don't press on that one, noone will.
"Ms. Skye, when you say 'A wound to the heart', you mean what this photograph shows?", Ivan asked, showing the Crime Photograph. "Well, you obviously do, so, let me ask: Why does this photograph shows the victim with a bullet wound... on the RIGHT side of his chest?"

Ema seemed slightly put off. She answered his question though.

"You see, the victim had a rare genetic defect which placed his heart on the right side of his body." Ema stared at the defense, with a questioning look.

"Why do you ask?"

The judge looked at Mr. Ramos and nodded, "I'm afraid Ms. Skye is correct, Mr. Ramos. The autopsy report states that his heart was indeed on the right side of his body. However, would you like it added to the testimony?"

Ramos: !!!!!
Gray: !!!!!

(WARNING! If you add this to your testimony, you must use the additional testimony or you will be Penalized one ! for wasting the court's time. As the health bar concept will be difficult with this trial, I will be using the Classic Five Exclamation points instead.)

Dominic frowned. "Well, it seems to be a dead end for now, sir," he whispered to Mr Ramos. "I bet that the real killer knew of this condition, but right now, our client's the only one who should have known it. If only there was someone else in this case who would know that much about Mr Doe..."

Jonothan spoke to Mr. Roxburghe in a whisper so no one else except Mr. Roxburghe could hear, "My boss's condition was made public to the entire medical community over thirty years ago and has been discussed that the person in question was named 'John Doe'. Therefore, anyone who wanted to could look up the medical records on my boss and kill him that way."

Ivan gasped. Yeah, it was in the Autopsy Report, but he thought he could have taken something more from that. "No, Your Honor, I don't want it added. I will continue the Cross-Examination, if I may."

"So, Ms. Skye, when you say "After analysis, it was revealed that the gun belonged to Mr. Jonathan Smith, the Defendant.", you mean fingerprint analysis?"

Ema actually smiled and got giddy for a bit, "Of course!, but we also were able to track were the gun was bought and confirmed that it was definately the defendant." Ema smirked and looked at the defense, "Any questions?"

Ivan listened to Detective Skye. "Yes, I supposed so.", he said. He finally had a lead. A small lead, a really small hint, that, for itself, wouldn't reveal much. But if he continued pressing on it, maybe it would get bigger. "So, Ms. Skye, if what you say is true, you should have revealed ALL fingerprints in the gun, didn't you? Then tell me,", he glanced at the Court Record. Yes, there it was, so he had proof. Now came the question. "why are the victim's fingerprints on this pistol too?"

"Ummm" Ema glanced at the prosecution and said, "Well, the victim knew the defendant had a gun, so it would only be logical that his fingerprints were on it." She began to sweat as the victim's secret was creeping up into the open.

"Oh, is that true? Then, Ms. Skye, there is something that's bothering me.", he said, confident that he was going to get something from here. "As the members of this court know, the most common way of not leaving any fingerprints is, of course, wearing gloves. And, Your Honor, as the Court Record states, the the victim... wore gloves."

"Well, you see..." Ema was put on the spot. How was she supposed to handle the situation? She put aside her conscious and said "The most likely scenario is that the victim used the gun without gloves at least once or that he wasn't wearing gloves recently." Ema oped the defense wouldn't come up with a counter arguement.

Dominic chuckled to himself. "Very cunning, sir, very cunning. I'd never have thought about the fingerprints." In a lower voice, he whispered, "By the way, I'm not sure if it's relevant, but I figured out what was bothering me about her testimony. It's just a case of counting, really, but it leaves us with a very interesting situation, if you think about it. But I think that will have to wait for later. For now, we just need to prove that John Doe was wearing gloves when he supposedly used the pistol. Simple enough for someone on as much of a roll as you."

"Yes, Mr. Roxburghe, that's exactly what I thought.", he adressed his assisstant. "I always press on something if it's fishy, because a witness (specially a Detective) would not contreadict him or herself so many times, so I've gotta do something about this. And, in addition, there is one peice of evidence that contradicts her claim, so..", he said, and went on...

"No, Ms. Skye, that is impossible. See, it is stated on the Court Record that Mr. Doe's, the victim's, gloves held an odd substance. And when I say odd I don't mean unknown, just hard to find in a pair of gloves. But this is a murder case and everything can happen. Back to the topic, and if the Court can please listen with attention, when a gun is shot, a substance, as you may know, is left in the shooter's person, most commonly in he or her's hands. This substance is called 'gunshot residue'. This is a lead that is followed every time a shooting is commited, because a simple analysis would determine who is the shooter. So explain me, Detective,", he said without stopping. Finally something to follow. It wasn't very relevant, but a contradiction always means something, he always said. "...Why did this gloves have traces of this so mentioned gunshot residue on them, meaning that he shot the pistol WITH the gloves on?"

((now then. I did notice Mr. Gray didn't post in a long while. i will request a prosecutor. Please hold the preceedings until i get one if at all possible.))

The judge looked at the prosecution's bench, which had been apparently empty for sometime without anyone noticing. He bangs his gavel, "Apparently, the prosecutor seems to have ducked out. Therefore, i cannot prolong the current line of questioning. We will take a brief recess to get a replacement."

Mr. Smith stood in the defendant's lobby, "You're not doing bad, Mr. Ramos. I'm impressed..."

OOC EDIT: ((I managed to snag a very special guest to fill in as prosecutor. Mr. Tails himself will be prosecution with an OC since Mr. Gray has run away. I will update the roster as soon as I get the name of his OC.))

Atticus Parks sprinted down the hallway. "Way to go Attie, late to your first Trial." He bobbed and weaved until he finally found the right Courtroom.

He opened the door tried to enter cooly and prompty tripped over his own feet. He got to his feet with a mumble.

"Uh, Hi! Atticus Parks, I'm the new Prosecutor." Attie said, scratching the back of his head.

:objection:

Attie paused, shocked by the sound of his own voice.

"Is there anyway to determine who wore the gloves? Perhaps the defendant left a hair or fingernail in one of the gloves."

Attie smiled, pleased with himself.

:objection:

"No, Mr. Parks, the only other person that could have been wearing the gloves was the defendant, but the pistol bears fingerprints of both the defendant and the victim! As we know, the victim's gloves held Gunshot Residue. Now, this means that the one wearing the gloves was the real killer.
HOWEVER! The gun hold both men's fingerprints, which implies that none of them was wearing gloves! Which let's us realise this: The killer couldn't have been my client or the victim himself!"

:objection: Attie fired back.

"Who is to say that the Defendant didn't fire the gun while wearing the glove, take the glove off, then pick the gun up again?"

Dominic stared at the prosecutor for a moment, open-mouthed. "Man, this guy's better than he looks." Whispering, Dominic added, "Sir, Mr Parks' theory makes sense... from his point of view. We'll need to hit him with something he doesn't know to get anywhere here. There are only two ways I can think of to do that: hope a witness' testimony somehow contradicts the theory, or prove that Mr Smith had greater worries on his mind than taking off the gloves." Dominic sighed, and shrugged his shoulders. "They're both risky, though, so if you've got a safer idea than use that."

Attie caught site of the stare. He smiled as if to say "Hi!" But something was bugging Atticus. But, he had to wait until the right moment to bring it up.
