Saki gives the defendant an alibi, because of the time-lapsus of the facts. You need to know this...
1.The Intermission of the play is of half an hour (30 minutes)
2.When the Intermission started, the defendant went to his dressing room, and then he got intercepted by Saki, and they talked about the play, their roles, and maybe to have a date someday... they talked around 10 minutes.
3.- When the defendant left Saki, Mr Shakespeare wanted to discuss something about his next play, and they argued about that... they argued for about 10 minutes.
4.- Finally, the defendant reached his dressing room, took of his Bloody Samurai Mask, drank a soda and then, he realized that he didn't had his Katana with him. He searched for it in his Dressing Room and Mr Okrainec reached his dressing room and they where talking for the rest of Intermission...
Then the defendant was took under arrest in his own dressing room, and he never went outside trying to find the katana and getting ready for the next part of the show.
Time was Everything Your honor!. Mr. Shakespeare was killed minutes later after the defendant left the arguement with him!The real Killer then stole the katana while The defendant was talking with Saki!"
