Seth blinked once. Les... sounds female to me. Oh well.

"Hm... You just said, or more accurately, stuttered, 'I saw them together.' Now in your testimony, you stated that you checked the van upon hearing a sound. Then when, if may I ask, did you actually see both of them together?
And if you did not know the victim, then what makes you so sure that it was Mr. Transit?"

"I never actually s-s-saw them together. That defendant there ran away after I heard the clunk. Then I went and checked the truck, and found the victim's body."

"Hm..." What's with the stuttering...

"So, how did you know it was Mr. Transit you found? And in fact, more importantly, why are you so sure that it was Mr. Didit you saw? Hearing your testimony, it sounds as if you just saw him passing by in the blink of an eye."

Objection

"Mr. Elune what are you trying to suggest? There was only one body at the scene of the crime. As for the defendant's appearance, remember the part of the witnesses' testimony where he got into the victim's truck? He wasn't simply running by."

The judge scratched his head with a pencil. He used the lead end however, and now had lines on his shiny cranium.

"Mr. Elune, do you have any way of proving it wasn't the defendant. If not, the objection will stand"

"I believe we are getting a little ahead of ourselves," Seth said. "In this situation, the point is not whether I can prove that it was not the defendant... My point is that I am a little unsure about the witness' testimony. Let me explain." He folded his arms, and continued, "Mr. Haulit did not know the defendant. The defendant passed by him twice: first, he entered the van, when the witness was eating his lunch. This shouldn't have caught his eye. The second time was when he returned after the witness heard the noise, and he ran away. I wonder... If the defendant was running away, and the witness did not know him, then how can he be sure of his identity?"

"I will concede the point that we cannot be 100% certain on this point. The witness was helped by the police to identify the man he saw by the standard method<police line up, photos, whichever your local police use...>. However you have to remember that we also have the defendant's fingerprints on the murder weapon as corroboration. So before you start trying to ask who else the witness could have seen, please answer the question of who would want to set up the defendant." Ron said challengingly.

(No problem. If your character has a natural stutter, then by all means.)

"Heheh."
Seth smirked. I daresay he's experienced something like that before. "We will get to that later. First, we need to clear up the facts and this testimony. I think that was enough discussion on that point.
Another thing... Were you able to see the victim's car from the office? And did you see anyone else around the crime scene that day?"

"ummmm....yes and no. I could s-s-s-see my truck, but I didn't see anyone else around that d-d-d-day."

((I'm actually not sure if the truck was visible. I'm going by that floor plan gerku posted, and i'm guessing there was a window in there.))

The Judge looked at the plans and readjusted his tie again. Seth looked at him for a second, and then looked down at the submitted plans and grinned. He'd finally found a contradiction.

The Judge stood in front of the mirror in his office and began to comb his beard. Today was the beginning of his 100th trial, a big milestone made even bigger by the fact it would be his birthday in two days time. He hoped this case wouldn't last three days; it's not fun working on your birthday, espeically if you had to do it two years running. He straightened his robe and sat down on his chair. He had a summary of the case infront of him and he began to re-read it.

Case DN-8
Crime: Triple Homicide (At different times on the same day)
Victims: #1: Ian Transit (M): Lorry (Truck) Driver Aged 25. Involved in a traffic accident with the suspect a few days previously (No-one was injured, although the suspects car was written off)
#2: U-glee Starr (F): Fruit seller aged 19. Accidently sold a rotten pear to the suspect on the same day of the accident, which gave him gastroenternal distress
#3: Duda Sums (F): CEO of Accountancy firm aged 35. Argued with the suspect once during his lunch break on the day of the two other incidents.

Suspect: Hugh Didit (M): Accountant aged 30. DNA evidence of him was found with all three victims, but seems to have little motive for at least two of the murders.

Witness: Les Haulit (M), Lorry (truck) Driver aged 29. Saw Suspect enter the van and exit at time of murder.

Evidence list
Autopsy report 1: Ian Transit Murdered 13/6*. Approx. Time of death: 1 PM. Location of death: In the back of his Lorry (Truck) Cause of death: Struck with Blunt object
Autopsy Report 2: Murdered 13/6*. Approx. Time of death: 2 PM. Location of death: In one of the racks of fruit. Cause of death: Strangled with object
Autopsy Report 3: Murdered 13/6*. Approx. Time of death: 3 PM. Location of death: IT Room of Accountancy Firm Cause of death: Shot
Club: Traces of 1st victims blood on it, has fingerprints of suspect
Suspect's Tie: Traces of 2nd victims blood on it, has fingerprints of suspect
Revolver: Ballistic markings on bullet match the revolver, has fingerprints of suspect.
--------------------------------------------------
The case seemed pretty clear-cut to him, but he knew that often the defence would find a crucial piece of missed evidence and the case would swing right round. Thats why he had to keep on his toes and try to keep an open mind. But the law is the law, and since the law changed to Guilty until proven Innocent he had to follow it.... Even if he missed the old way of doing it. He got out of his seat and walked out of his office towards the courtroom; It was time for another trial to begin.

100th trial is not a big milestone AT ALL! Judge's deal with like 15 or more trials every day!

A watertight testimony, eh? I think not...

:objection:

Seth slammed his desk with his right hand, flicking the plans up with his left hand. "Mr. Haulit. There is something very peculiar about your testimony. Let us take a look at the plans. You were in the office. If that is the case... Then how were you able to see the defendant's face?"
He banged the floor plans down on his desk, so that both hands were now resting on it. "There are no windows in the office. You could not have seen the defendant's face from inside the office!"

"Come on Mr. Elune, didn't you pay attention to the witness's testimony? He wasn't in the office when he saw the defendant the first time, he was coming out of it. And here's the proof!"

I came back out at 12:59, and saw that there defendant there climb into the victim's car.
